EU Data Act Summary for End Users (Careium Connected Products)

This summary explains, in plain language, what data your Careium connected product and related services generate, how you can access it, and what rights you have under the EU Data Act (Regulation (EU) 2023/2854). This summary is for convenience only. The Data Annex to your customer agreement contains the binding legal terms.

1. What is “Data”?

Your connected product and related service may generate and send “product data” and “related service data,” such as:

  • operational status (e.g., device health, events)
  • alarms and alarm-related events
  • location-related data (where applicable and enabled)
  • device identifiers and configuration (e.g., model, firmware/software version)
  • connectivity and performance metrics (e.g., error logs), where needed to provide the service

2. How is the Data used?

Careium uses Data to:

  • provide the services you have requested (including alarms and monitoring)
  • provide support, warranty, troubleshooting, and claim handling
  • maintain safety, security, and quality
  • improve existing products and services and develop new ones (including AI), subject to law
  • create aggregated/derived datasets that do not identify you or a specific device’s transmissions

3. How can I access my Data?

From 12 September 2025, you can request access by creating a support ticket via the channel Careium notifies to you). Careium may provide Data through a secure download, transfer, or API, depending on what is feasible and what is set out in your Data Annex.

4. Can I ask Careium to share my Data with a third party?

Yes. You can request that Careium share your Data with a third party you choose, subject to the EU Data Act and the Data Annex (including security, authentication, and trade secret safeguards). In some cases, Careium may not be allowed to share Data with certain recipients (e.g., “gatekeepers”), or may have to apply protective measures

5. Are there limits on what I can do with Data?

Yes. For example, you must not:

  • use Data to build a competing connected product
  • use Data to derive insights about Careium’s economic situation, assets, or production methods
  • use coercive means or exploit vulnerabilities to access Data
  • use Data for unlawful purposes

6. Trade secrets and security

Some Data may contain Careium trade secrets. Careium may require confidentiality commitments and apply reasonable security measures before providing access or sharing.

7. How long is Data kept?

Careium retains Data only as long as necessary for the stated purposes and as set out in your customer agreement/Data Annex, unless a longer period is required or permitted by law. Data is never stored for more than two years, regardless of purpose.

8. Complaints

If you believe the EU Data Act has been breached, you may lodge a complaint with the competent authority designated under Article 37 of the EU Data Act in your jurisdiction.
